How an off-market sale works, and what Arizona's rules allow, at the estate level.
Selling a Paradise Valley Estate Privately (Updated Q4 2026)

I'm Clayton Wolfe, Partner at The Agency in Scottsdale. Some estate owners want to test the market without a public listing. A private, pre-market process can do that, within clear rules.
This is the estate-tier version of the off-market approach on my development page's Skip the Market section. It is about controlled exposure, not secrecy.
Two sets of rules govern it. Arizona's advertising rule, effective December 13, 2025, requires written owner consent before a licensee publishes that a specific property is for sale. ARMLS Clear Cooperation governs how long a home can stay off the open market once it is marketed.
I explain below what a private sale can do, what it cannot, and how to stay inside both rules.
Pre-market exposure, not a public listing. I introduce a home quietly to qualified buyers and their advisors before any public marketing. The goal is to find the right buyer while keeping price history clean and showings controlled.
The Agency's private network. The Agency operates a private-listing channel across its offices and agents. It lets me share a home with a vetted internal audience before, or instead of, a public launch, where the owner consents in writing.
Written owner consent comes first. Under Arizona's December 13, 2025 rule, I secure the owner's written consent before publishing anywhere that a specific property is offered for sale. That includes signs and any electronic medium. No consent, no publication.
Clear Cooperation sets the clock. Once a home is publicly marketed, ARMLS Clear Cooperation requires it to be submitted to the MLS within a short window. A quiet, agent-to-agent introduction is handled differently from public marketing, so the sequence matters.
Coming Soon and Temporarily Off Market. ARMLS Coming Soon status can satisfy the submission requirement while limiting exposure, and Temporarily Off Market status requires the seller's written permission. I use the status that matches the owner's goal.
Who a private sale fits. It fits owners who value discretion, who are testing a number, or whose home shows better by appointment than in photos. It does not fit an owner who needs the widest possible buyer pool quickly.
Can you sell without ever listing publicly? Sometimes, if the right buyer is in the private network and the owner consents in writing. But an off-market sale usually trades a wider buyer pool for discretion.
What does the December 2025 Arizona rule require? Under Arizona Department of Real Estate rule R4-28-502, effective December 13, 2025, a licensee must secure the owner's written consent before publishing, by sign or any electronic medium, that a specific property is offered for sale.
What is Clear Cooperation? It is an ARMLS and NAR policy. Once a listing broker publicly markets a property, the listing must be submitted to the MLS within one business day. Private, office-exclusive handling is treated differently.
Does Coming Soon count? Yes. ARMLS Coming Soon status satisfies the submission requirement while limiting public exposure for a defined period.
Are new builds exempt? ARMLS exempts to-be-built homes without a Certificate of Occupancy from Clear Cooperation. Finished homes are not exempt.
Where do I see what is actually for sale? Current inventory is always a live search on my site, not a named private home. See Paradise Valley homes for sale.
